City and Coffee Giant May Head To Court

Canadian Coffee giant Tim Hortons could be taking the city of Kingston to court over its official plan and anti-idling bylaw. Lawyers for the company argue that drive throughs are better for the environment when it comes to emissions than parking lots so drivers shouldn’t be the penalized for idling their cars while waiting for a cup of joe. The company has also petitioned the minister of municipal affairs to block Kingston’s official plan because it has issues with 50 metre setbacks for drive throughs from residential properties and the impact the lanes could have on traffic flow and pedestrians. The city’s planning department and lawyers will meet again next Monday to try come to an understanding before an official plan appeal is filed.
